Our Estate Planning practice is aimed at helping clients who desire to organize and plan their estate in order to better ensure that their loved ones receive their inheritance with a minimum of inconvenience and cost upon their death. This usually means considering strategies and techniques designed to avoid probate and minimize the costs of administration upon their death, to minimize or avoid inheritance taxes, and to implement the clients’ expressed wishes with regard to the disposition of their wealth.

Our Basic Estate Planning practice is for the client whose estate requires no planning for the estate tax or special family circumstances. For this client, we typically would prepare any one or more of the following:

  • Last Will and Testament
  • Simple Revocable Trust
  • Joint Revocable Trust
  • Durable Power of Attorney
  • Living Will
  • Health Care Durable Power of Attorney
  • General Warranty Deed or Beneficiary Deed for Real Estate
  • Beneficiary Designation for various non-probate assets

Our Advanced Estate Planning practice is for the client whose estate requires advanced planning for special family circumstances, Tax issues or both. In addition to providing the basic instruments described above, we provide this client advice and implementation with one or more of the following:

  • Gift planning
  • Irrevocable Life Insurance Trust
  • Integration with planning for a closely held business
  • Revocable trust provisions that allow a trust to last for a child’s lifetime, in order to provide protection from a child’s possible creditors and the possibility of tax planning
  • Revocable trust provisions that provide flexibility for a long-term trust, such as powers of appointment and powers to change trustees
  • Flexible provisions that deal with scheduled changes in the gift, estate and generation-skipping transfer taxes
